Mental Capacity Act

I am currently a student at Sheffield University studying criminology and social policy. As part as our social policy module we have been given the task to evaluate the provisions of the Mental Capacity Act of 2005. I am interested in finding out whether as carers, you are aware of this Act and whether it has had any impact on the problems it was intended to address. Any information on this topic would be greatly appreciated. Many Thanks.

Fri 2 Nov 2007 11:22Hi I am a carer and know about this act but from some comments from carers not all professionls seem to recognise this act for eg it says ' no one can be regarded as incapable simply as a result of age medical condition etc and those caring for someone who is lacking capacity must be consulted concerning a persons best interests 'this part seems to be ignored as how not many carers / person views are considered let alone consulted ?
This is one statement that is not always respected and I am sure their are a few more. so maybe a few more professionals ought to review the act

Tue 19 Feb 2008 19:37i am aware of it but only because my daugter is just going into transition services i feel it is good but could cause problems ie as the mother of o girl with learning dssailities unless i apply for power of attourney my wishes regardind such things as the pill would be ignored it could be dangerous

Thu 21 Feb 2008 03:03I'll tell you one thing and it is the 'most' powerful and painstaking hindrance to a parent/carer in the Mental Capacity Act especially is your Child/Adult was Abducted by Social Services and that is " A Parent is owed No Right to see or contact the Child/Adult...it is the Child/Adult who has to ask to see you" and when SS Lies says that your Child/Adult refuses to see you that is your 'worst nightmare'.
I know coz they kidnapped my son and tried to disappear him forever, we had No Contact for 5 months, until his younger brother met him on the streets looking like a Vagrant that lived on the streets, and is like they have done no wrong, it was me, coz I bailed him and took him to ss offices for an Asessment and they then 'conspired' and kidnapped him, they never offered him a care a package even though I chased them, but, once he got arrested because his misconception about Sex and Relationship they then came alive reacting to a crisis, I can go onn and onn.. but..
I want to SUE them, they are barbarians..
