DISABILITY LIVING ALLOWANCE - BACKDATED?

MY HUSBAND WAS FINALLY AWARDED DISABILITY LIVING ALLOWANCE FOR HIS LIFELONG DISABILITY, LAST YEAR. WE HAD PUT IN A CLAIM FOR DLA ABOUT SIX YEARS AGO AND HIS CONDITION HASN'T CHANGED AND ISN'T EVER LIKELY TO..... DOES ANYONE KNOW WHETHER IT'S POSSIBLE TO GET THE DLA BACKDATED TO THE DATE OF OUR FIRST CLAIM?

Thu 12 Jun 2008 15:16Check with the CAB as i think there is a time limit, but you should argue your case and back it up with any letters the DLA sent you.

I'm not sure how long they can backdate it to, but I know it can be done:
A few years back I found out a friend of mine had been told her son (who was blatantly severely disabled) couldnt get it cos his disability didnt have a name (Huh!) but i worked as a benefits advisor at the time for mencap and saw red when she told me so she reapplied and got it, high rate and also got it backdated for about a year- she got around 4 grand i think it was at the time

Fri 13 Jun 2008 00:08Also check tax credits, i told them in my annual review that my son had been awarded DLA just after my last annual review then packin it cause i thought they would demand money back but instead they gave us more and back dated it to the tune of over 2k i was shell shocked so if you get tax credits tell them

Fri 13 Jun 2008 16:50yeah els right cos you can get a disability premium of around £42 pw on top of your usual tax credits.
