Mental capacity - Have the tax people heard of it?!

I had a reply to a letter I sent on the 3rd September to the Tax people today.... (not my first letter or phonecall I might add)
Thanking me for my letter, and saying sorry but the Court of Protection Reciever means nothing to them and will I please get Power of attorney from my dad to be able to deal with them about his tax bill...
Which part of the 'he hasn't got mental capacity to give me power of attorney and thats why I went through the bloody court of protection process three years ago' do they not understand!!!
I have the legal ability to act on his behalf!
I swear I am going to copy the mental capacity act and hand deliver it to them myself!
I'm off to hit my head against a brick wall....

Tue 20 Nov 2007 17:05Hi, it should have read the 'Court of Protection'.
When someone is unable to manage their affairs they give power of attorney to someone, but in some people (like my dad) they can't give power of attorney to someone because they don't have the mental capacity to do so (in my dads case short term memory loss). If there is no previous POA or EPOA in place then you have to go through the Court of Protection to get 'recievership' although since Oct were now called 'deputies' and the Court of Protection are now the office of Public Guardianship.
Anyway its a very lengthy (and costly) process with lots of forms and u have to get medical statements etc and its really frustrating when organisations don't know what your talking about! Esp with the recent hype about the Mental Capacity Act.
